Hon’ble Gujarat High Court at Ahmedabad set aside the order acquitting the Vadodara woman doctor who conducted the pregnancy test.

વડોદરા ડિસ્ટ્રીકટ એપ્રોપ્રીએટ ઓથોરીટી દ્વારા કરાયેલી અપીલ મંજૂર રાખતા ગુજરાત હાઇકોર્ટે પ્રિ-કન્સેપ્શન અને પ્રિનેટલ ડાયગનોસ્ટિક ટેકનીક્સ (પીસી એન્ડ પીએનડીટી) એકટની જોગવાઇઓનો ચુકાદો આપ્યો હતો.

Allowing the appeal filed by the Vadodara District Appropriate Authority, Gujarat High Court gave the verdict on the provisions of the Pre-Conception and Prenatal Diagnostic Techniques (PC & PNDT) Act.

પીસી પીએનડીટી ભંગ હેઠળ વડોદરાના એક મહિલા તબીબને કેસમાંથી એકટની કલમ-28(1) હેઠળ જયારે મહિલા તબીબને બિનતહોમત છોડી મૂકતા હુકમને, ગુજરાત હાઇકોર્ટે આજ રોજ એક મહત્ત્વના ચુકાદા મારફતે ગેરકાયદે અને રદબાતલ ઠરાવ્યો છે અને ઠરાવ્યું હતું કે જ્યારે એક એપ્રોપ્રિએટ ઓથોરીટીએ એફઆઇઆર દાખલ કરી હોય તો તે ટકવાપાત્ર છે. આરોપી મહિલા તબીબ વિરુદ્ધ છ મહિનામાં ટ્રાયલ ચલાવી પૂર્ણ કરવા હાઇકોર્ટે ટ્રાયલ કોર્ટને આદેશ અપાયો હતો અને વડોદરા એપ્રોપ્રીયેટ ઓથોરીટીની અપીલ મંજૂર કરવામાં આવી હતી

The Gujarat High Court, in a landmark judgment, has declared the order of acquitting a woman doctor of Vadodara under Section-28(1) of the Act under section 28(1) of the Act as illegal and void in a landmark judgment and held that an FIR lodged by an appropriate authority is maintainable. The High Court ordered the trial court to complete the trial against the accused woman doctor within six months and allowed the appeal of the Vadodara appropriate authority.

પીસીપીએનડીટી એકટની જોગવાઇઓના ભંગ બદલના ગંભીર ગુનાના કેસમાં આરોપી મહિલા તબીબને ડિસ્ચાર્જ કરતાં બિનતહોમત છોડી મૂકતા વડોદરા ચીફ જયુડીશીયલ મેજિસ્ટ્રેટના હુકમને માનનીય ગુજરાત હાઈકોર્ટના જસ્ટિસ નિશા એમ.ઠાકોરે રદબાતલ કરાવ્યો હતો અને આરોપી મહિલા ડોકટર વિરૂધ્ધના કેસની ટ્રાયલ છ મહિનામાં ચલાવી આદેશ કર્યો હતો. આ ઉપરાંત ઓનરેબલ ગુજરાત હાઈકોર્ટે બંને પક્ષના પક્ષકારોને પણ ટ્રાયલના ઝડપી નિકાલની દિશામાં યોગ્ય અને પૂરતો સાથે સહકાર આપવા સ્પષ્ટ તાકીદ કરી હતી.

Hon’ble Gujarat High Court has quashed the order of the Vadodara Chief Judicial Magistrate discharging the accused woman doctor in the case of serious crime of violation of the provisions of the PCPNDT Act and ordered the trial of the case against the accused woman doctor to be conducted in six months. Apart from this, the Hon’ble Gujarat High Court also clearly urged the parties on both sides to cooperate properly and adequately in the direction of speedy disposal of the trial.

ઓનરેબલ ગુજરાત હાઇકોર્ટે ઠરાવ્યું હતું કે, પીસી-પીએનડીટી એકટની કલમ-28(1) (બી)ના જોગવાઇની અમલવારી નહી થઇ હોવાના એકમાત્ર ગ્રાઉન્ડ પર ફરિપાદ રદ કરી દેવાઇ હતી ત્યારે ઓરીજનલ એફઆઇઆર પુર્નજીવિત થાય છે.

The Hon’ble Gujarat High Court held that the original FIR was revived when the appeal was quashed on the sole ground that the provisions of Section-28(1) (b) of the PC-PNDT Act had not been implemented.

વડોદરાના મહિલા ડોકટરને પીએનડીટી એકટની જોગવાઇઓના ભંગના ગુના માં આરોપી મહિલા તબીબને ડિસ્ચાર્જ કરતા બિન તહોમત છોડી મૂકતા ટ્રાયલ કોર્ટના હુકમ સામે એપ્રોપ્રીએટ ઓથોરીટી દ્વારા કરાયેલી અપીલમાં ઓથોરિટી તરફેનાં એડવોકેટે દલીલો કરતાં જણાવ્યું હતું કે, પીસીપીએનડીટી એક્ટની જોગવાઇઓના ભંગ બદલ આરોપી મહિલા ડોકટર સામે પ્રથમ દર્શનીય ગુનો બને છે.

In the appeal filed by the appropriate authority against the order of the trial court discharging the woman doctor accused of violation of the provisions of the PNDT Act in Vadodara, the advocate for the authority said that the violation of the provisions of the PCPNDT Act is a first cognizable offence against the accused woman doctor.

વડોદરા એપ્રોપ્રીયેટ ઓથોરિટીએ આરોપી મહિલા મહિલા તબીબ વિરૂદ્ધ કાયદેસર ફરિયાદ નોંધાવી હતી અને ટ્રાયલ કોર્ટના ચીફ જયુડીશીયલ મેજિસ્ટ્રેટનાં ડોકટરને નિર્દોષ છોડી દેવાના હુકમને પડકારતી અપીલ દાખલ કરવામાં આવી હતી જેની સુનાવણી દરમ્યાન હાઇકોર્ટે ઓબસર્વ કર્યું કે ટ્રાયલ કોર્ટે પીસીપીએનડીટી એકટની કલમ-28 ની જોગવાઇઓ ધ્યાનમાં લેવામાં ગંભીર ચૂક દાખવી છે.

The Vadodara Appropriate Authority filed a legal complaint against the accused woman doctor and an appeal was filed challenging the order of the Chief Judicial Magistrate of the trial court acquitting the doctor, during the hearing of which the High Court observed that the trial court committed serious lapses in considering the provisions of Section-28 of the PCPNDT Act.

પ્રસ્તુત કેસમાં કાયદામાં નિર્દિષ્ટ આદેશાત્મક જોગવાઇઓનું અનુસરણ કરવામાં આવ્યું છે. જે જોગવાઇ મુજબ ડિસ્ટ્રીકટ એપ્રોપ્રીએટ ઓથોરીટીએ આરોપી મહિલા ડોકટર વિરૂધ્ધ કાયદેસરની ફરિયાદ નોંધાવી હતી જેમાં ટ્રાયલ કોર્ટના માનનીય મેજિસ્ટ્રેટ સાહેબ દ્વારા PCPNDT એક્ટ ની કલમ 28 ની જોગવાઈઓ ને ધ્યાન લેવામાં ગંભીર ચૂક થઈ છે.

In the present case the mandatory provisions specified in the Act have been followed. According to which the District Appropriate Authority filed a legal complaint against the accused lady doctor in which the Hon’ble Magistrate of the trial court has seriously failed to consider the provisions of Section 28 of the PCPNDT Act.

ખુદ સરકારના તારીખ 09/11/2001 નાં જાહેરનામામાં એપ્રોપ્રિયેટ ઓથોરિટી ને આ માટે અધિકૃત કરવામાં આવી છે અને તે અંગેની સત્તાઓ બક્ષવામાં આવી છે માટે ટ્રાયલ કોર્ટ નો હુકમ કે જેમાં ડોકટરને નિર્દોષ છોડી મૂકવાનો નિર્ણય લેવામાં આવેલો તે હુકમ ભૂલ ભરેલો અને ક્ષતિયુકત છે તેમ જણાવવામાં આવ્યું.આ ઉપરાંત ઓનરેબલ ગુજરાત હાઇકોર્ટે ઓબઝરવ કર્યું કે ટ્રાયલ કોર્ટે હકીકત ધ્યાને લેવામાં ચૂક દાખવી છે.

The Government itself vide notification dated 09/11/2001 authorised the appropriate authority and delegated the powers in this regard therefore the order of the trial court in which the decision to acquit the doctor was stated to be erroneous and vitiated. .Furthermore, the Hon’ble Gujarat High Court observed that the trial court has failed to consider the facts.

જસ્ટિસ એ પોતાના ચુકાદામાં ઠરાવ્યું હતું કે, પ્રસ્તુત કેસમાં એપ્રોપ્રીએટ ઓથોરીટી દ્વારા એફઆઇઆર દાખલ થઇ છે અને ખુદ સરકારના જાહેરનામાથી તેને અધિકૃત કરાઇ છે ત્યારે કાયદાકીય જોગવાઇઓનું પૂરતું પાલન થયુ છે. એપ્રોપ્રીએટ ઓથોરીટી ના બદલે અન્ય કોઈ વ્યકિતએ ફરિયાદ નોંધાવી હોય ત્યારે કલમ-28(1) ની કલોઝ (બી) લાગુ પાડવાની વાત આવે પરંતુ પ્રસ્તુત કેસમાં તો એપ્રોપ્રીએટ ઓથોરીટીએ જાતે જ એફઆઇઆર નોંધાવી છે તેથી તેમની અપીલ મંજૂર કરવામાં આવે છે અને આરોપી મહિલા તબીબને ડિસ્ચાર્જ કરતો હુકમ રદબાતલ ઠરાવવામાં આવે છે.

Justice in her judgment ruled that in the present case, the FIR has been lodged by the appropriate authority and the legal provisions have been sufficiently complied with when the same has been authorised by the government’s notification. Clause (b) of Article 28(1) is applicable when the complaint is lodged by some other person instead of the appropriate authority, but in the present case, the appropriate authority has itself registered the FIR, hence their appeal is allowed and the order discharging the accused lady doctor is set aside.

ખુદ સરકારના તા. 09-11-2001ના જાહેરનામામાં એપ્રોપ્રીએટ ઓથોરીટીને આ માટે અધિકૃત કરવામાં આવ્યા છે અને તે અંગેની સત્તાઓ બક્ષવામાં આવી છે. આમ, ટ્રાયલ કૉર્ટનો હુકમ ખોટો, ભૂલભરેલો અને ક્ષતિયુક્ત છે અને આરોપી મહિલા તબીબને ડિસ્ચાર્જ કરતો હુકમ રદબાતલ ઠરાવવામાં આવે છે.

Date of the government itself. Notification dated 09-11-2001 authorized the appropriate authority and conferred powers in this regard. Thus, the order of the trial court is wrong, erroneous and vitiated and the order discharging the accused lady doctor is set aside.
