The Code of Criminal Procedure (CrPC) Section-84, Claims and objections to attachment

(1) If any claim is preferred to, or objection made to the attachment of, any property attached under section 83, within six months from the date of such attachment, by any person other than the proclaimed person, on the ground that the claimant or objector has an interest in such property and that such interest is not liable to attachment under section 83, the claim or objection shall be inquired into, and may be allowed or disallowed in whole or in part: Provided that any claim preferred or objection made within the period allowed by this- sub- section may, in the event of the death of the claimant or objector, be continued by his legal representative.

(2) Claims or objections under sub- section (1) may be preferred or made in the Court by which the order of attachment is issued, or, if the claim or objection is in respect of property attached under an order endorsed under sub- section (2) of section 83, in the Court of the Chief Judicial Magistrate of the district in which the attachment is made.

(3) Every such claim or objection shall be inquired into by the Court in which it is preferred or made: Provided that, if it is preferred or made in the Court of a Chief Judicial Magistrate, he may make it over for disposal to any Magistrate subordinate to him.

(4) Any person whose claim or objection has been disallowed in whole or in part by an order under sub- section (1) may, within a period of one year from the date of such order, institute a suit to establish the right which he claims in respect of the property in dispute; but subject to the result of such suit, if any, the order shall be conclusive.

दंड प्रक्रिया संहिता की धारा की धारा 84 के अनुसार :कुर्की के बारे में दावे और आपत्तियां

(1) यदि धारा 83 के अधीन कु र्क की गई किसी संपत्ति के बारे में उस कुर्की की तारीख से छह मास के भीतर कोई व्यक्ति, जो उद्घोषित व्यक्ति से भिन्न है, इस आधार पर दावा या उसके कुर्क किए जाने पर आपत्ति करता है कि दावेदार या आपत्तिकर्ता का उस संपत्ति में कोई हित है और ऐसा हित धारा 83 के अधीन कुर्क नहीं किया जा सकता तो उस दावे या आपत्ति की जांच की जाएगी, और उसे पूर्णतः या भागतः मंजूर या नामंजूर किया जा सकता है : परंतु इस उपधारा द्वारा अनुज्ञात अवधि के अंदर किए गए किसी दावे या आपत्ति को दावेदार या आपत्तिकर्ता की मृत्यु हो जाने की दशा में उसके विधिक प्रतिनिधि द्वारा चालू रखा जा सकता है।

(2) उपधारा (1) के अधीन दावे या आपत्तियां उस न्यायालय में, जिसके द्वारा कुर्की का आदेश जारी किया गया है, या यदि दावा या आपत्ति ऐसी संपत्ति के बारे में है जो धारा 83 की उपधारा (2) के अधीन पृष्ठांकित आदेश के अधीन कुर्क की गई है तो, उस जिले के, जिसमें कुर्की की जाती है मुख्य न्यायिक मजिस्ट्रेट के न्यायालय में की जा सकती है।

(2) પેટા-કલમ (1) હેઠળના દાવા કે વાંધા જે કોર્ટ જપ્તીનો હુકમ કાઢયો હોય તે કોર્ટ માં કરી કે ઉઠાવી શકાશે અથવા જો તે દાવો કે વાંધો કલમ 83ની પેટા-કલમ (2) અનુસાર શેરો કરેલા હુકમ હેઠળ જપ્તીમાં લીધેલી મિલકત સંબંધમાં હોય તો, જે જિલ્લામાં જપ્તી કરવામાં આવી હોય તે જિલ્લાના ચીફ જયુડિશિયલ મેજિસ્ટ્રેટની કોર્ટમાં કરી કે ઉઠાવી શકાશે.

(3) એવો દરેક દાવો કે વાંધો જે કોર્ટમાં કરવામાં કે ઉઠાવવામાં આવ્યો હોય તે કોર્ટ તેની તપાસ કરવી જોઇશે પરંતુ તે ચીફ જયુડિશિયલ મેજિસ્ટ્રેટની કોર્ટમાં કરવામાં આવ્યો હોય કે ઉઠાવવામાં આવ્યો હોય તો તેઓ પોતાની સત્તા નીચેના કોઇ પણ મેજિસ્ટ્રેટને તેનો નિકાલ કરવા માટે સોંપી શકશે.
