જે વિસ્તારમાં અશાંત ધારો લાગું કરવામાં આવ્યો હોય તે વિસ્તારમાં કોઈપણ જાતની રેસીડેંશીયલ કે કોમર્શીયલ મિલ્કત જેમ કે ફ્લેટ, બંગ્લો, પ્લોટ, ટેનામેંટ, રો-હાઉસ, કોઈપણ જાતનુ મકાન કે ઓફીસ, દુકાનમ ગોડાઉંન, ઇંડસ્ટ્રીયલ શેડ કે પ્લોટ કે એવી કોઈપણ મિલ્કત લેવી કે વેચવી હોય તો અશાંતધારા હેઠળ સરકારી નિયંત્રણ લાગે છે અને જો મિલ્કતના માલીકે આવી મિલકત વેચવી હોય તો પોતાના વિસ્તારના/ જિલ્લાના કલેક્ટરને જાણ કરવી પડે અને તેમની મંજુરી લેવી પડે અને તે માટે તેઓએ આવી મિલકત તેઓ કોને વેચી રહ્યા છો તેની વિગતો આપવી પડે છે. જિલ્લા કલેક્ટર આવી મિલ્કતના ખરીદનાર અને વેચનારની સુનાવણી હાથ ધરે છે અને કલેક્ટર સાહેબને યોગ્ય લાગે તો જ આ સોદો થયેલો માન્ય ગણાય છે અને ત્યારબાદ તેમની મંજુરી બાદ જ વેચાણ દસ્તાવેજ / સેલ-ડીડ થઈ શકે છે આ માટે અશાંત ધારામાં કલેક્ટરને કેટલીક વિશેષ સત્તાઓ આપવામાં આવી છે. અશાંત ધારા હેઠળના વિસ્તારોમાં કોઈ મિલકતો ટ્રાન્સફર થઇ હોય તેમાં કલેક્ટરને કોઈ શંકા જાય તો ‘સુઓ મોટો’ ફરિયાદ દાખલ કરી પોતાની રીતે તપાસ કરીને મિલકત ટ્રાન્સફર માટે તૈયાર થયેલા માલિકને એની મિલકત પાછી અપાવી શકે છે અને ખરીદનાર પાસેથી એવી મિલ્કત, વેચનારને પાછી આપી દેવાની ફરજ પાડતી સત્તાનો ઉપયોગ કરે છે.

કોમી તોફાનો પછી મિલકતોની જબરજસ્તીથી કે સામ દામ દંડ ભેદની તરકીબ થી મિલ્કતોની ખરીદ-વેચાણની ફરિયાદો વધી ગઈ હતી. અશાંત ધારો એવા સ્થાન /વિસ્તાર માંની મિલ્કતો ઉપર લગાવાય છે કે જ્યાં વારંવાર બે કોમ વચ્ચે તણાવ થતો હોય. બે કોમ વચ્ચે વર્ચસ્વ વધારવા માટે મિલકત ખરીદીને સામેની કોમ પર દબાણ ઊભું કરાતું હોય. જેના પગલે આ અશાંત ધારાનો કાયદો લાગુ કરવામાં આવ્યો.
